There, the police force and panchayat secretary were sent and the goods lying in their land were removed and dumped near the pond. They have submitted a written complaint to the Deputy Commissioner and demanded action against the block development and panchayat officer. On the other hand, the block development and panchayat officer has described this allegation as baseless and said that the said land belongs to the panchayat. The case of which is going on in the court of District Development and Panchayat Officer And meanwhile, bricks and other materials were strewn in that land by the two brothers during the night after which this action has been taken.
In the letter written to the Deputy Commissioner, Ajaib Singh and Harmesh Singh, residents of Bakarpur, have written that their place falls within the population of the village within the red line. The case at this place was decided in his favor by the Hon'ble Court Additional Civil Judge Senior Division SAS Nagar on 1.5.2015. And later on 13.8.2018 Additional District Judge SAS Nagar passed a decree in their favor. The petition of the other party in this regard was dismissed by the Hon'ble Punjab and Haryana High Court on 18.1.2019 and gave a decision in their favour.
He said that at that place, a regular gate has been installed by them by walling it, where it is locked and a water tap is also installed inside. He said that later a case of Saxon (7) was filed by the Sarpanch Gram Panchayat in the court of Deputy Commissioner-cum-Collector Panchayat Mohali that this land belongs to the Panchayat. In response to which they challenged the Panchayat to prove the ownership of the land by making a case under section (11) in the court of Collector Panchayat Mohali. He said that while hearing the matter, the case of Section (7) was closed by the District Development and Panchayat Officer-cum-Collector Mohali on 24.11.2022.
He said that on June 24, BDPO Mohali Dhannawat Singh sent Harpinderjit Pal Panchayat Secretary with police force and JCB machine and took away his building construction materials lying there and sent them away. He said that no advance notice was given to him by BDPO regarding this action.
He said that on this occasion, he also showed the orders of the honorable courts to the panchayat secretary and the police, but they did not pay attention to the orders of the court and returned their goods. They have demanded from the Deputy Commissioner to give them justice and take appropriate action against BDPO Mohali.
On being contacted in this regard, BDPO Mr. Dhanwant Singh Ranghawa said that it is the property of the panchayat where some material was released for possession by these people, and their case is going on in the court of DDPO. He said that the department had told the said persons that while the matter is in the court, nothing should be done here. On asking that the complainant alleges that the Hon'ble Sessions Court had passed a decree in his favor and later the Hon'ble High Court had also upheld that judgment and in that place the complainant There is also possession And the case filed by the village panchayat in the court of DDP under Section 7 has been closed Then in which case this action was taken, they said that now the case of Section 11 is going on and the complainant cannot keep the goods there again. He said that the old possession of the complainant has not been tampered with and only the goods kept by him in the place on the night of 23rd June have been removed. They said that they have only done their duty and the allegations being leveled against them are completely baseless.
Panchayat Secretary Harpinder Jeet Pal, who went to the spot to make arrangements in this regard, said that the complainant had blocked the road by throwing material on the ground at night. The villagers had complained in the BDPO office after which this action has been taken by the department.
