SDM issues Order for Demolition of Unauthorized Liquor Vend in Kaimbwalao

Chandigarh, 25th May 2024 – In compliance with the orders dated 15 May 2024 by the Hon'ble Punjab & Haryana High Court, Chandigarh, an order has been issued by the Sub Divisional Magistrate (Central) under Section 12(2) of the Punjab New Capital (Periphery) Control Act, 1952, for the demolition of an unauthorized Liquor vend in Kaimbwala village, U.T., Chandigarh.

Chandigarh, 25th May 2024 – In compliance with the orders dated 15 May 2024 by the Hon'ble Punjab & Haryana High Court, Chandigarh, an order has been issued by the Sub Divisional Magistrate (Central) under Section 12(2) of the Punjab New Capital (Periphery) Control Act, 1952, for the demolition of an unauthorized Liquor vend in Kaimbwala village, U.T., Chandigarh. The structure measuring 12' x 20' is a liquor vend constructed on agricultural land (Khasra No. 22//7-14) in the periphery area of Kaimbwala village, which is declared as a controlled area. This construction of illegal liquor vend contravenes Sections 5, 6, and 11 of the Punjab New Capital (Periphery) Control Act, 1952. A notice was issued on 6 May 2024, giving the violator an opportunity to present their case on 15 May 2024. Despite multiple opportunities, no satisfactory reply was submitted. During the hearing, it was contended by the Naib Tehsildar (Periphery) that the liquor vend structure is also unauthorized and falling within the Sukhna Catchment area where construction is prohited, as per the Orders of the Hon'ble Punjab and Haryana High Court in CWP No. 18253 of 2009 dated 2 March 2020. In accordance with Section 12 of the Act, the Sub Divisional Magistrate (Central) has directed the violator to demolish the unauthorized Liquor vend construction within six weeks from the issuance of the order and restore the land to its original state. Failure to comply will result in the administration taking necessary measures for demolition, and the cost of such demolition will be recovered as arrears of land revenue. Deputy Commissioner Vinay Partap Singh informed that multiple complaints were received against the illegal liquor vend and hence action has been taken. SDM has written to Excise & Taxation Commissioner to take necessary action for cancellation of liquor license of the vend as the vend has been constructed illegally in violation of Periphery Control Act 1952
